The short version

  • These terms apply when you use Daytrove.
  • Daytrove is not a medical device. Do not rely on it for medical decisions or in an emergency.
  • You keep the rights to your data. The privacy policy explains how we handle it.
  • You can export your data or delete your account at any time.
  • We provide Daytrove with reasonable care but cannot promise it is always available or error-free. Our liability is limited as explained below, except where the law does not allow a limit.

Who we are

Daytrove is provided by Pankaj Singh, a sole proprietor trading as Doon Digital (Doon Apps in the app stores), Lane No. 5G, Shimla Bypass Rd, Shivraj Nagar, Mehuwala, Badowala, Dehradun, Uttarakhand 248007, India ("we", "us"). These terms are an agreement between you and us.

Accepting these terms

By creating an account or using Daytrove, you accept these terms and the Daytrove privacy policy. If you do not accept them, do not use Daytrove.

Who can use Daytrove

  • You must be at least 18 to use Daytrove. It is not meant for children.
  • You need an email address that you control, because that is how you sign in.

Your account

#
  • Daytrove has no passwords. You sign in with a one-time code sent to your email address, or with Google or Apple where Daytrove offers it.
  • Keep your email account and your devices secure. Anyone who can read your email can sign in to your account.
  • If you think someone else has access to your account, use Settings > Account > Sign out everywhere and contact us.

What Daytrove is and is not

  • Daytrove helps you keep track of your own activity, sleep, heart data and daily logs.
  • Daytrove is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.
  • Scores, totals and trends are estimates. They depend on data from your devices and other apps, and that data can be wrong or incomplete.
  • Do not use Daytrove in an emergency. Talk to a doctor or another healthcare professional about anything that worries you, and before you change a treatment.
  • Reminders are scheduled on your device and may not arrive, for example when notifications are turned off. Do not rely on them alone.

Your data

  • You keep the rights to the data you add or import. You let us store and process it only to provide Daytrove to you, as the privacy policy explains.
  • Export: Settings > Data > Export my data.
  • Delete your account: Settings > Data > Delete account. The privacy policy explains what is deleted and when.

Other services

#
  • Daytrove works with Apple Health, Health Connect and Open Food Facts, and can let you sign in with Google or Apple. Their own terms apply when you use them.
  • Food data comes from Open Food Facts, a database anyone can add to. It can be incomplete or wrong, so check the product label.
  • We do not control the data that other apps and devices save to Apple Health or Health Connect.

Using Daytrove fairly

Do not:

  • try to get into anyone else's account or data
  • overload or disrupt the service, or get around its limits or security checks
  • use Daytrove to break the law

We may limit or suspend an account that does these things. Where we can, we tell you first.

Price

#

Daytrove has no paid plans today. If we add one, we show the price and its terms before you pay. Purchases through the App Store or Google Play also follow those stores' terms.

Changes to Daytrove

#
  • Daytrove is still being built. Features may change or be removed, and the service may sometimes be unavailable.
  • You can stop using Daytrove and delete your account at any time.

Warranties and liability

  • What we promise: we provide Daytrove with reasonable care and skill, handle your data as the privacy policy describes, and fix, within a reasonable time, problems that we are responsible for.
  • What we cannot promise: Daytrove is provided as it is and as available. We do not promise that it will always be available or free of errors, that it will suit your particular purpose, or that data from your devices, other apps, Apple Health, Health Connect or Open Food Facts is accurate. Apart from the promises in these terms and in the privacy policy, we make no other promises, express or implied, to the extent the law allows.
  • Your health decisions: Daytrove is not a medical device. To the extent the law allows, we are not responsible for decisions about your health, diet, exercise or treatment that you make on the strength of Daytrove alone.
  • Losses we are not responsible for: losses that were not reasonably foreseeable when you started using Daytrove, losses caused by events outside our reasonable control, losses caused by your breach of these terms, and loss of business, income or profit. Daytrove is for your personal use.
  • Limit: apart from the cases in the next point, our total liability to you for all claims about Daytrove is limited to the greater of what you paid us for Daytrove in the 12 months before the claim and INR 5,000. Daytrove is free today, so the limit is INR 5,000.
  • What these terms never limit or exclude: our liability for death or personal injury caused by our negligence, for fraud or wilful misconduct, for failing to protect your personal data as data protection law requires, including the Information Technology Act, 2000 and its rules, and any other liability that the law does not allow us to limit or exclude. Nor do they affect your rights as a consumer under the Consumer Protection Act, 2019, or under the consumer laws of the country where you live that an agreement cannot take away.

Apple devices

If you downloaded Daytrove from the App Store:

  • Apple's standard licensed application end user license agreement also applies.
  • These terms are between you and us, not Apple. Apple is not responsible for Daytrove or its content, for maintaining or supporting it, or for any claim about it, including product liability, legal compliance and intellectual property claims.
  • If Daytrove fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund what you paid for it, if anything. To the extent the law allows, Apple has no other warranty obligation for Daytrove.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

Governing law and courts

These terms are governed by the laws of India. The courts at Dehradun, Uttarakhand can hear disputes about them. If you live in another country, you keep any consumer rights that its law gives you and that an agreement cannot take away, including any right to bring a claim in your own courts.

Changes to these terms

#

When we change these terms, we update the version and date at the top. When the version changes, the app asks you to accept the new version before you continue.
